1. Introduction
Welcome to the website of Deendayal Soni and Sons Jewellers. By accessing our website, contacting us, requesting a quotation, or placing an order, you agree to these Terms & Conditions.
We specialise in handcrafted, made-to-order jewellery, including Kundan Meena, Jadau, Polki, traditional gold jewellery, and gemstone jewellery.
Please read these terms carefully before placing an order.
2. Products and Craftsmanship
Our jewellery is handcrafted by skilled artisans. Due to the nature of traditional jewellery-making, minor variations may occur in finishing, engraving, Meenakari, stone placement, design details, colour, and overall appearance.
Each handcrafted piece has its own character. Reference photographs, sample designs, sketches, and digital previews are intended to communicate the design and may not represent every detail of the finished product exactly.
Natural gemstones and uncut diamonds may vary in colour, shape, inclusions, texture, and appearance.
Such normal variations are not automatically considered defects or grounds for a refund. However, if a product has a material defect, is materially different from the agreed specifications, or does not match the order in a significant way, please contact us so we can assess and resolve the issue fairly.
3. Made-to-Order Jewellery
Many of our products are manufactured specifically according to the customer's requirements.
Before confirming a custom order, customers should review the agreed details, including where applicable:
- Design, dimensions, and product specifications.
- Gold purity and the agreed metal details.
- Gemstone type, quality, colour, and other agreed characteristics.
- Meenakari, engraving, and other customisation requirements.
- Estimated production and delivery timelines.
- Price, applicable taxes, advance payment, and balance payment.
The final order specifications confirmed in writing will form the basis of the order.
Any change requested after confirmation may affect the price, production timeline, or feasibility of the design. Additional charges may apply, subject to the customer's approval.
4. Product Images and Descriptions
We make reasonable efforts to display accurate product photographs and descriptions. However, the appearance of jewellery may differ slightly due to lighting, photography, screen settings, handcrafted processes, and the natural characteristics of materials.
Customers should contact us before ordering if they require clarification regarding a product's specifications.
5. Pricing and Quotations
Prices may depend on the prevailing gold rate, metal purity, gemstone specifications, design complexity, labour, wastage where applicable, and applicable taxes.
A quotation will be based on the details and pricing method communicated to the customer at the time of quotation or order confirmation.
Where a quotation specifies a validity period, the price may be revised after that period expires.
If the agreed pricing method is linked to the gold rate on a specified date or production milestone, that method will be communicated and confirmed before the order is finalised.
Any material price revision outside the agreed pricing terms will be communicated to the customer for approval before proceeding.
6. Advance Payment and Order Confirmation
An order is considered confirmed once the required order details and payment terms have been accepted by both parties and the agreed advance payment has been received.
The advance payment amount will be communicated before the customer makes payment.
For custom-made jewellery, advance payments may be used to procure gold, gemstones, and other materials and to begin production.
The treatment of any advance payment in the event of cancellation will be subject to the agreed order terms, actual work completed, materials procured, reasonable and lawful costs, and applicable law.
No advance payment will be treated as automatically forfeited where such forfeiture is prohibited by law.
Customers should retain their payment receipts and written order confirmation.
7. Order Changes and Cancellations
Customers should carefully review and approve all specifications before confirming a custom order.
Once production has started, changes or cancellation may not always be possible because materials may have been procured or work may already have been completed.
If a customer requests a change or cancellation, we will assess the request and communicate any applicable costs, production implications, and refund eligibility in accordance with the agreed terms and applicable law.
We reserve the right to decline a requested design change where it is technically impractical or would materially affect the agreed product.
If we are unable to fulfil a confirmed order, we will contact the customer to discuss an appropriate resolution, including a refund where applicable.
8. Production and Delivery Timelines
Production timelines depend on the complexity of the design, material availability, gemstone sourcing, artisan workload, and the level of customisation.
Estimated timelines will be communicated during order confirmation. Custom orders may require approximately 25–35 working days, while particularly complex designs may require 45–60 working days or longer.
These timelines are estimates unless a specific delivery date has been expressly agreed in writing.
If a significant delay occurs, we will make reasonable efforts to inform the customer and provide an updated estimate.
9. Shipping and Delivery
Orders will be dispatched using a suitable delivery or courier service to the address provided by the customer.
Customers are responsible for providing accurate contact details and a complete delivery address.
Delivery timelines may be affected by courier operations, weather, transport disruptions, public holidays, security checks, or circumstances beyond our reasonable control.
Tracking information will be shared where available.
Any shipping, insurance, or special delivery charges applicable to an order will be communicated to the customer.
10. Inspection Upon Delivery
Customers are encouraged to inspect their parcel and jewellery promptly after delivery.
If a parcel appears tampered with, damaged, incomplete, or incorrect, please contact us as soon as reasonably possible. Where available, retain the packaging, invoice, shipping label, and photographs or videos that document the issue.
We may request reasonable evidence to help investigate a reported problem.
Any requested reporting period communicated with an order is intended to help us investigate quickly and does not remove statutory rights that cannot lawfully be excluded.
11. Returns, Refunds, and Exchanges
Because many of our products are handcrafted or made to order, we do not offer routine returns or exchanges merely because a customer changes their mind, dislikes the finished design despite approving the specifications, or no longer wishes to keep the product, except where required by applicable law or expressly agreed by us.
This policy does not exclude remedies that may be available under applicable law, including where an item is defective, materially different from the confirmed order, incorrectly supplied, or otherwise eligible for a remedy under applicable law.
If you experience a problem with your order, please contact us with your order details and supporting information. We will review the matter and communicate an appropriate resolution.
Any approved refund will be processed through an appropriate payment method, subject to applicable law and reasonable verification requirements.
12. Gemstones and Precious Materials
Gemstones, natural uncut diamonds, pearls, and other natural materials can have inherent variations in colour, shape, inclusions, texture, and appearance.
Customers should confirm the agreed gemstone type, quality, size, colour range, and other material specifications before placing an order.
Where a particular gemstone or material is unavailable, we will seek the customer's approval before making a material substitution.
We will not knowingly substitute a materially different agreed gemstone or metal specification without appropriate disclosure and agreement, except where permitted by applicable law.
Any representation regarding gemstone origin, treatment, certification, or grading will be based on the information actually available and communicated for the relevant product.
13. Gold Purity, Weight, and Hallmarking
Gold purity, finished weight, and hallmarking details will be communicated or documented as applicable to the specific product and order.
The final weight of a handcrafted item may vary within reasonable manufacturing tolerances where disclosed or agreed. Any material difference from the confirmed specifications will be addressed in accordance with the order terms and applicable law.
Where hallmarking is legally required, the applicable legal requirements will be followed.
Customers may request clarification regarding the specifications of their order before confirming it.
14. Product Care and Maintenance
Jewellery should be handled and stored carefully. Perfumes, chemicals, cosmetics, moisture, impact, and improper storage may affect metals, gemstones, enamel, or other decorative elements.
Customers should follow any care instructions provided with their jewellery.
Damage caused by misuse, accidental impact, unauthorised alterations, improper cleaning, or ordinary wear and tear will be assessed based on the circumstances and applicable law.
If repairs or maintenance are available, any charges and expected timelines will be communicated before the work begins.
15. Payments and Taxes
Payments must be made using the payment methods communicated by us, such as bank transfer or UPI, or another method expressly accepted for the order.
Applicable taxes, including GST where required by law, will be charged and documented in accordance with applicable tax requirements.
Customers should confirm the final price, applicable taxes, payment schedule, and any additional charges before making payment.
Invoices and payment confirmations will be issued as applicable to the transaction and legal requirements.
16. Customer Responsibilities
Customers agree to provide accurate information, review the confirmed order specifications, make payments according to the agreed schedule, and cooperate reasonably when clarification is needed.
Customers should promptly notify us if their contact information or delivery details change before dispatch.
We are not responsible for delivery problems caused by incorrect details supplied by the customer, subject to applicable law.
17. Intellectual Property
Unless otherwise agreed in writing, website content, photographs, product descriptions, logos, branding, original designs, and other materials created or owned by Deendayal Soni and Sons Jewellers remain our intellectual property or are used with permission.
You may not reproduce, distribute, commercially exploit, or publish our protected material without prior written permission, except where permitted by law.
Customers must ensure that any design, image, or reference they provide does not unlawfully infringe another party's intellectual property rights.
18. Website Use
Customers must not use our website for unlawful purposes, attempt to interfere with its operation or security, submit fraudulent information, or misuse website content.
We may update, suspend, or modify website features, product listings, and content when reasonably necessary.
We make reasonable efforts to maintain accurate information but do not guarantee uninterrupted or error-free website operation.
Nothing in these terms excludes any responsibility that cannot lawfully be excluded.
19. Privacy and Personal Information
Personal information supplied during enquiries, purchases, payments, and delivery will be handled in accordance with our Privacy Policy and applicable data protection laws.
We may use relevant information to respond to enquiries, process orders, arrange delivery, manage payments, provide customer support, and meet legal obligations.
We will not claim to use security measures, data retention practices, or third-party services that are not actually in place.
Please refer to our Privacy Policy for further details.
20. Limitation of Liability
To the extent permitted by applicable law, we will not be liable for indirect or consequential losses arising from circumstances beyond our reasonable control.
Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation is prohibited by law, including applicable consumer protection rights and remedies.
Any issue relating to an order will be assessed in light of the confirmed specifications, the circumstances, and applicable law.
21. Events Beyond Our Reasonable Control
We will not be considered in breach of these terms solely because performance is delayed by circumstances beyond our reasonable control, such as natural disasters, transport interruptions, government restrictions, significant supply disruptions, or other comparable events.
We will make reasonable efforts to communicate material delays and resume performance when practicable.
This clause does not remove any refund or other obligation that applies under law.
22. Changes to These Terms
We may update these Terms & Conditions from time to time.
The updated version will be published on our website with a revised effective date where appropriate. Changes will generally apply prospectively and will not override an existing confirmed order's agreed terms unless the parties agree or applicable law requires otherwise.
Customers should review the terms before placing a new order.
23. Severability
If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent legally permissible.
Any invalid provision will be interpreted or limited only to the extent necessary to comply with applicable law.
